Proposed WAC 458-61A-202 - explains the REET implications of transfers to heirs or devisees, subsequent transfers by an heir, and other survivorship-related transfers. Recognizing SSB 6851, which identifies specific documentation requirements for an exemption for the community propery interest of a decedent that is transferred to a surviving spouse or surviving domestic partner, and 2SHB 3104.

Proposed WAC 458-61A-203 - explains the REET implications of the transfers of community property between spouses, subsequent transfers by the spouse, and transfers between ex-spouses. Recognizing 2SHB 3104 which expanded the rights, privileges, obligations, and liabilities of domestic partners and domestic partnerships registered under chapter 26.60 RCW.
